NVM Nvrmnd App — Terms of Service

Welcome to the NVM Nvrmnd app ("the App"), operated by NVM Nvrmnd ("we," "us," "our"). By downloading, accessing, or using the App, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. The App

NVM Nvrmnd is a music streaming and fan-engagement app that lets you stream music, purchase access to select releases, save playlists, write private journal entries, and receive updates about new releases, shows, and merchandise.

2. Accounts

To use certain features (playlists, journal, purchases), you must create an account with an email and password. You're responsible for keeping your login credentials secure and for all activity under your account. You may delete your account at any time from within the App; this permanently removes your account, playlists, journal entries, and purchase history.

3. Content and Music

All music, artwork, and related content in the App is owned by NVM Nvrmnd or used with permission. Some releases are free to stream; others require a one-time payment (pay-what-you-want) to unlock, after which they are yours to stream permanently within the App.

You may listen to and enjoy this content for personal, non-commercial use only. You may not copy, redistribute, resell, publicly perform, or otherwise exploit the music or artwork outside the App without our prior written permission.

4. Purchases

Purchases made through the App are processed through Apple's In-App Purchase system. Pricing is pay-what-you-want, with a minimum amount set per release. Once purchased, access to that release is tied to your account and does not expire. All purchases are final; if you believe a purchase was made in error, contact Apple for a refund through their standard App Store refund process, as we do not have the ability to issue refunds directly.

5. The Journal

The Journal is a private, personal writing space within the App, optionally linked to the song you're listening to. Journal entries are visible only to you and are stored securely. We do not read, share, or use your journal entries for any purpose other than displaying them back to you.

6. Notifications

If you enable push notifications, we may send you updates about new releases, upcoming shows, and merchandise drops. You can disable notifications at any time in your device settings.

7. Acceptable Use

You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the App's underlying code or media files
- Interfere with or disrupt the App's functionality or servers
- Impersonate any person or misrepresent your affiliation with NVM Nvrmnd

8. Third-Party Links

The App includes links to our merch store and social media. We are not responsible for the content, policies, or practices of these third-party sites.

9. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee the App will be uninterrupted, error-free, or available at all times.

10. Limitation of Liability

To the fullest extent permitted by law, NVM Nvrmnd is not liable for any indirect, incidental, or consequential damages arising from your use of the App.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. We will update the "Last updated" date above when changes are made.
